Employment law

Key rules every employer should know

Every employee must be registered, and employers remit contributions every month. Rates and salary caps are updated periodically.

Vietnam has no legal 13th-month salary. Many employers pay a Tet bonus, so decide early and accrue it monthly.

Probation length depends on the role. Contracts are indefinite or fixed-term.

Annual leave, public holidays including Tet, sick leave and maternity leave are set by the Labour Code.

Notice is at least 45 days for indefinite contracts. Severance applies after 12 months of service, unless the employee is dismissed for misconduct.

Foreign nationals usually need a work permit under Decree 219/2025, and the process can take several months.
